Terms of Service

JoosJoos is a wholly owned and operated service provided by GOTTAGOTTA, Inc. a California corporation.  All references below of JoosJoos or to the JoosJoos Service or JoosJoos Site (AKA JoosJoos Services) or to other GOTTAGOTTA Services or Sites (AKA GOTTAGOTTA Servers) below are transferred to the service, property and rights and privileges of GOTTAGOTTA, Inc (AKA GOTTAGOTTA).  Using or joining the JoosJoos site and services means that you are an adult as defined by the Children’s Online Privacy Protection Act of 1998.

Using the JoosJoos Services or GOTTAGOTTA Services

As a user, your activities on this site are conducted with the understanding that you are solely responsible for placing bookmarks, blogs, messages, emails, files, photos and any other information to the JoosJoos Service or GOTTAGOTTA Services.  When placing any information on JoosJoos Service or GOTTAGOTTA Services you are aware that if placed in a public or private location that the information can be seen and commented upon by others.  This is true even if you are placing your information on a private directory, for instance.

Additionally, by placing your information, files, bookmarks, blogs and photos on JoosJoos Service or GOTTAGOTTA Services that you hereby grant us, our affiliates, and our partners a worldwide, irrevocable, royalty-free, nonexclusive, license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute your information, files, blogs, files and photos.

All information that you provide us must provide be true, accurate, current, and complete.  It is your responsibility to update your account information. If we provide you with a password, you must not share it with others. If you discover any unauthorized use of your passwords or accounts or any other breach of security, you must notify us immediately. You understand that if you do not exit from your accounts at the end of each session it could result in unauthorized use of your accounts. Thusly, we will not be responsible for any loss or damage that may result if you fail to comply with these requirements.

The application, code, advertising, photos, graphics and all services and sites are the property of GOTTAGOTTA, our affiliates, and our partners. Thusly, you cannot distribute, alter, sell, loan or rent, reverse engineer, grant a security interest in, or otherwise transfer any right to the software of our sites or the Services without our permission.

You will not use our sites to any of the following activities or actions:

  1. Defame, abuse, harass, stalk, threaten, or otherwise violate the legal right of others;
  2. Publish, post, upload, e-mail, distribute, or disseminate (collectively, “Transmit”) any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content;
  3. Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person’s computer, our sites, any software or hardware, or telecommunications equipment;
  4. Advertise or offer to sell any goods or services for any commercial purpose unless you have our written consent to do so;
  5. Transmit surveys, contests, pyramid schemes, spam, unsolicited advertising or promotional materials, or chain letters;
  6. Download any file that you know or reasonably should know cannot be legally obtained in such manner;
  7. Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material;
  8. Restrict or inhibit any other user from using and enjoying any public area within our sites;
  9. Collect or store personal information about other end users;
  10. Interfere with or disrupt our sites, servers, or networks;
  11. Impersonate any person or entity, including, but not limited to, a GOTTAGOTTA representative, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  12. Forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through our sites or to manipulate your presence on our sites;
  13. Take any action that imposes an unreasonably or disproportionately large load on our infrastructure;
  14. Engage in any illegal activities.
  15. Post content or initiate communications that are unlawful, libelous, abusive, obscene, discriminatory, or otherwise objectionable.
  16. Use the JoosJoos Service or GOTTAGOTTA Services for any illegal purpose, including but not limited to conspiring to violate laws.
  17. Falsely state, impersonate, or otherwise misrepresent your identity, including but not limited to the use of a pseudonym, or misrepresenting your current or previous positions and qualifications, or your affiliations with a person or entity, past or present.
  18. Upload, post, email, transmit or otherwise make available any content or initiate communications which include information that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
  19. Upload, post, email, transmit or otherwise make available any content or initiate communication that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights.
  20. Collect or store personal data about other users, including but not limited to information about another user’s work experience, skills, or reputation information or metadata such as the number or identity of contacts in another user’s GOTTAGOTTA network (via the JoosJoos Service or GOTTAGOTTA Services).
  21. Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation. This prohibition includes but is not limited to a) Using JoosJoos Service or GOTTAGOTTA Services invitations to send messages to people who don’t know you or who are unlikely to recognize you as a known contact; b) Using the JoosJoos Service or GOTTAGOTTA Services to connect to people who don’t know you and then sending unsolicited promotional messages to those direct connections without their permission; and c) Sending messages to distribution lists, newsgroup aliases, or group aliases.
  22. Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  23. Stalk or harass anyone.
  24. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any communication transmitted through the JoosJoos Service or GOTTAGOTTA Services.
  25. Post content in fields that aren’t intended for that content. Example: Putting an address in a name or title field.
  26. Interfere with or disrupt the JoosJoos Service or GOTTAGOTTA Services networks connected to the JoosJoos or GOTTAGOTTA servers, or disobey any requirements, procedures, policies or regulations of networks connected to the JoosJoos Service or GOTTAGOTTA Services.
  27. Choose a username that, in our sole discretion, is obscene, indecent, abusive or that might otherwise subject us to public disparagement or scorn, we reserve the right, without prior notice to you, to automatically change your username, delete your posts from our sites, deny you access to our sites, or any combination of these actions

Content Links

People over whom GOTTAGOTTA exercises no control develop the sites displayed on GOTTAGOTTA pages or linked to by GOTTAGOTTA. Automated machinery and computers create the pages that appear in the JoosJoos Service or GOTTAGOTTA Services, and GOTTAGOTTA cannot and does not screen the source sites or content before including them in our pages. A GOTTAGOTTA page may provide links to sites and/or content that some people find objectionable, inappropriate, or offensive. We cannot guarantee that a GOTTAGOTTA page will not display unintended or objectionable content and assume no responsibility for the content of any site included in our pages or otherwise linked to by GOTTAGOTTA.

Commercial User of the JoosJoos Service or GOTTAGOTTA Services

Making commercial use of any JoosJoos Service or GOTTAGOTTA Services must first be made into an agreement with GOTTAGOTTA in advance.

Intellectual Property

All materials, information, photos and files that are place by you on the JoosJoos Service or other GOTTAGOTTA services are subject the Digital Millennium Copyright Act. GOTTAGOTTA will vigorously comply with any inquiries that may emerge because of your activities. The same is true for any materials that have been copyrighted or trademarked in the United States or other countries. If you infringe on any of these laws and acts, you will be the responsible party and GOTTAGOTTA will assist in any way to have you prosecuted.

If you have any questions as to whether you should post any materials or information that may infringe on the copyright and trademark acts, you should contact the owner of the copyright or trademark BEFORE placing them on the JoosJoos Service or GOTTAGOTTA Services.

We cannot guarantee that the JoosJoos Service or GOTTAGOTTA Services will not locate unintended or objectionable content and GOTTAGOTTA accepts no responsibility or liability for the content of any site included in any JoosJoos or GOTTAGOTTA page or otherwise linked to by the JoosJoos Service or GOTTAGOTTA Services, or for your use of such content.  GOTTAGOTTA reserves the right to remove any pictures or content without notice to you, any other user, or any third party.

We will review all claims of copyright infringement received and remove any information or content that infringes on the copyright and trademark acts.

Warranty Disclaimer

GOTTAGOTTA has no special relationship with or fiduciary duty to User. User acknowledges that GOTTAGOTTA has no control over, and no duty to take any action regarding: which users gain access to the Site; what Content User accesses via the Site; what effects the Content may have on User; how User may interpret or use the Content; or what actions User may take as a result of having been exposed to the Content. User releases GOTTAGOTTA from all liability for User having acquired or not acquired Content through the Site. The Site may contain, or direct User to sites containing, information that some people may find offensive or inappropriate. GOTTAGOTTA makes no representations concerning any content contained in or accessed through the JoosJoos Service or GOTTAGOTTA Services, and GOTTAGOTTA will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Site. THE SERVICES, CONTENT, SITE AND ANY SOFTWARE ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO USER.

ELECTRONIC COMMUNICATIONS PRIVACY ACT NOTICE (18 USC 2701-2711): GOTTAGOTTA MAKES NO GUARANTY OF CONFIDENTIALITY OR PRIVACY OF ANY COMMUNICATION OR INFORMATION TRANSMITTED ON THE SITE OR ANY WEB-SITE LINKED TO THE SITE. GOTTAGOTTA will not be liable for the privacy of email addresses, registration and identification information, disk space, communications, confidential or trade-secret information, or any other Content stored on GOTTAGOTTA’s equipment, transmitted over networks accessed by the Site, or otherwise connected with User’s use of the Services.

Limitation of Liability

IN NO EVENT SHALL GOTTAGOTTA BE LIABLE WITH RESPECT TO THE SITE OR THE SERVICES (A) FOR ANY AMOUNT IN THE AGGREGATE IN EXCESS OF THE FEES PAID BY USER THEREFOR; OR (B) FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO USER.
Changing our Terms of Service

From time to time we may choose to change any part of our Terms of Service. When changes are made, they will be immediately effective.
